1. Introduction
Welcome to LevelUp Toronto. These Terms of Service ("Terms") govern your use of our website and services located at 405 Richmond Street West, Toronto, ON M5V 3A8, Canada. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access our services.
2. Definitions
"Service" refers to the gaming club, facilities, equipment, and digital platforms provided by LevelUp Toronto.
"User", "You" and "Your" refers to the person accessing or using the Service.
"Company", "We", "Our" and "Us" refers to LevelUp Toronto.
"Content" refers to text, images, videos, audio, graphics, and all other forms of data or communication.
3. Membership and Registration
To use certain features of our Service, you may be required to register for an account and/or purchase a membership. When you register, you agree to provide accurate, current, and complete information about yourself as prompted. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.
Memberships are personal and non-transferable. We reserve the right to refuse service, terminate accounts, or cancel memberships at our discretion.
4. Age Restrictions
Users under the age of 16 must be accompanied by a parent or legal guardian while using our facilities. Users under the age of 13 may not create accounts or use certain services without direct parental supervision. Some game content may be subject to age restrictions as determined by game ratings or our policies.
5. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Engage in any form of harassment or bullying
- Distribute or display harmful or offensive content
- Attempt to gain unauthorized access to any part of the Service
- Interfere with the operation of the Service or other users' enjoyment of the Service
- Engage in any activity that could damage, disable, or impair the Service or related equipment
- Use cheating software, hacks, or other unauthorized third-party software
6. Equipment and Facilities
All equipment provided by LevelUp Toronto remains our property. Users are responsible for using equipment with care and may be held financially responsible for damage resulting from misuse or negligence. Food and drinks are only permitted in designated areas. We reserve the right to inspect personal equipment brought into our facilities for security purposes.
7. Reservations and Cancellations
Station reservations may be made in advance through our website, mobile app, or in person. Cancellations must be made at least 2 hours before the scheduled reservation time to avoid cancellation fees. No-shows may result in additional charges or restrictions on future reservations. We reserve the right to limit reservation duration during peak hours.
8. Payment and Refunds
All prices are displayed in Canadian Dollars (CAD) and are subject to applicable taxes. Payment is required at the time of service or reservation unless other arrangements have been made. We accept major credit cards, debit cards, and cash.
Refund policies vary by service type:
- Hourly gaming sessions: No refunds after service has begun
- Memberships: Refundable within 7 days of purchase with a 15% administrative fee
- Tournament entries: Non-refundable within 48 hours of the event
- Private events: Subject to the terms specified in the event contract
9. Intellectual Property Rights
The Service and its original content, features, and functionality are owned by LevelUp Toronto and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any materials from our Service without our prior written consent.
10. User-Generated Content
By posting content to our Service or during events (including social media posts tagged with our location or hashtags), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, publicly display, reproduce, and distribute such content on our platforms for promotional purposes.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy.
12. Limitation of Liability
To the maximum extent permitted by law, LevelUp Toronto shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the Service. This includes damages for loss of profits, goodwill, data, or other intangible losses, even if we have been advised of the possibility of such damages.
13. Indemnification
You agree to defend, indemnify, and hold harmless LevelUp Toronto, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Toronto, Ontario.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the Service after any changes indicates your acceptance of the modified Terms.
